What late night refreshment means

Late night refreshment is one of the licensable activities set out in the Licensing Act 2003. Schedule 2 of the Act defines it as the supply of hot food or hot drink to the public between 11pm and 5am. It sits separately from the sale of alcohol, and this notice asks to change only that one activity, on four nights of the week.

How to comment, and by when

Representations can be made for or against an application, and the notice sets out where they go:

  • In writing to: Licensing Service, Luton Borough Council, Town Hall, Luton, Beds, LU1 2BQ
  • By: 28 days from the date of the notice. The notice is dated 8 September 2026, so that is Tuesday 6 October 2026
  • To read the application first: a copy is kept at the Town Hall and can be seen during normal office hours, or on the council’s online licensing register

The notice also carries the statutory warning that it is an offence knowingly or recklessly to make a false statement in connection with an application. The maximum fine on summary conviction is a level 5 fine on the standard scale.

What it means for you

If you live or work near Bute Street, the practical change is one hour, on four nights of the week. Nothing else on the licence moves: Friday, Saturday and Sunday stay exactly as they are, and so do the layout, the conditions and the type of business. If that hour matters to you, either way, the council’s licensing team is the place a view counts, it has to be in writing, and it has to arrive before the 28 days are up.
